It's Reefer Madness 2.0 In Texas Right Now. Stop Dan Patrick's "THC Ban" Bill

***UPDATE 4.7.25: Dan Patrick's "THC Ban" bill (SB3) has passed in the senate, as expected. SB3 is now being reviewed in the House.

On Monday (4/7), we had the opportunity to attend the House Committee hearing for SB3 and HB28–an equally destructive bill written by the alcohol lobby.

We do not only oppose SB3 and HB28–we fully support the need for legislation that adds safety regulations to keep bad actors out of the hemp industry.

Hemp companies like ours and 1000s of other legitimate hemp businesses across Texas are making and/or selling safe, natural, lab tested, federally legal hemp-derived THC products to millions of Texans who enjoy or rely on them. We need a bill that does not restrict us or the people of Texas from these products.

Contact your legislators. Tell them to VOTE NO on SB3 and HB28. Ask them to instead pass legislation that adds safety regulations to the multi-billion dollar Texas hemp industry.

Subject: Vote NO on SB3 – Protect Texas’ Hemp Industry, Free Markets, & Personal Freedoms

Dear [Legislator’s Name],

I am writing to express my strong opposition to Senate Bill 3 (SB3) and House Bill 28 (HB28). Both bills will effectively shut down Texas’ legal hemp industry. These bills are not about public safety—they're about eliminating competition to benefit the alcohol industry and our criminally restrictive medical marijuana program (TCUP).

The Texas Compassionate Use Program (TCUP), controlled primarily by Texas Original, is a heavily restricted, anti-competitive program that fails to serve Texans in need. The thriving Texas hemp market, which operates legally under the 2018 Federal Farm Bill, provides safe, lab-tested, and affordable alternatives for consumers. Rather than banning an entire industry, reasonable regulations should be implemented to eliminate bad actors while preserving free market competition.

Similarly, the Texas liquor lobby, who is responsible for HB28, is attempting to outlaw all hemp-derived products aside from lab-converted THC beverages, which they would control through the 3 tier system.

The recent Senate Committee Hearing, followed by Dan Patrick's press conference, was filled with misleading testimony, fear-mongering, and deliberate misinformation equating legal hemp products with synthetic and unregulated substances. The truth is:

✅ No one has ever died from THC consumption. Law enforcement claims of “THC overdoses” are misleading and inaccurate.

✅ Texans deserve access to legal, affordable, and high-quality hemp products. The free market ensures better products and lower prices for consumers, unlike the overpriced, restricted options under TCUP. Millions of Texans enjoy or rely on these products. Outlawing them will only push this multi-billion dollar demand to the black market.

✅ We support reasonable regulations, not prohibition. The real issue is enforcing laws against unregulated, mislabeled products—not banning an entire industry that follows federal guidelines. According to a recent poll conducted by Baselice & Associates, Inc, Texan's overwhelmingly support keeping hemp-derived THC product legal with reasonable safety regulations. Only 20% of Texans support banning these products, according to the poll.

I urge you to vote NO on SB3 and HB28 and stand against corporate-backed corruption that limits consumer choice and personal freedom. Texans deserve an open and competitive market, not a government-sanctioned monopoly.

Please do the right thing and protect Texas’ hemp industry. Thank you for your time and consideration.
